CGT deduction for planning permission fees?
Question:
We have recently incurred architect, planning permission, planning consultant and legal fees in obtaining planning permission for some plots of land we own.
The granting of planning permission for a development of flats will significantly increase the value of the land which we intend to sell on (ie not develop the properties ourselves).
My question is:
Can the fees (approximately £15,000 per property) be deducted from the proceeds for the purpose of the Capital Gains Tax calculation?
Answer:
Yes, the fees of obtaining planning permission should be deductible expenditure when calculating the chargeable gain on a future disposal of the properties.
Under the legislation when calculating the capital gain arising you are permitted to deduct any 'enhancement expenditure' you incur on an asset sold. In order to qualify as enhancement expenditure, expenditure must satisfy all the following conditions. It must:
- be on the asset
- have been incurred for the purpose of enhancing the value of the asset
- be reflected in the state or nature of the asset at the date of disposal.
In your case, the expenditure in obtaining planning permission should satisfy these tests, particularly given it will significantly increase the value of the property at the disposal date.
As such in our view the expenditure would be deductible.
