Establishing non residence if not resident anywhere? - USERNAME: Itabuna - 16/09/2021
Tax Question:
Hi
Is it possible to be a tax nomad, i.e to not meet resident criteria anywhere due to extensive travelling.
Specifically, if one becomes non resident uk ( as determined by the statutory residence test), woukd HMRC have a problem with one not being tax resident elsewhere. In other words, do HMRC accept tax nomads.?
Many thanks for your consideration.
Answer:
Residence is determined by the statutory residence test. This is the legislative source for the residence rules. There are a couple of occasions where foreign residence can be taken into account but generally in terms of establishing non residence there is nothing in the SRT to prevent you being non resident if not establishing tax residence overseas.
