Buying a property in the United States tax efficiently

L J Hadnum -
The United States and in particular Florida has grown in popularity as a location for purchasing an overseas holiday home or an overseas investment property. The capital growth on some properties has been huge with growth of over 100% in some cases. In this case getting the right ownership structure in place right at the start is crucial as it can be expensive to rectify later. For example anyone using a UK company to purchase United States property (perhaps to save on the income tax charge on extraction) would find that there was a significant tax charge in the company on the uplift in value if they tried to sell the property (or even on transferring it to themselves). Aside from the UK taxes it's also important to consider the United States tax position. They have both federal and state taxes and the state taxes in Florida for example can be significant. For anyone considering purchasing such a property in the US obtaining a tax analysis can be time consuming and expensive. I've therefore prepared an article looking at the UK and US tax position summarising the different options and suggesting the preferred course.
