Moving overseas to avoid CGT

L J Hadnum -
This is a tremendously popular subject. The UK, unlike many other countries does not tax capital gains that arise on many UK assets if you're a non UK resident (and ordinary resident). This means that someone holding assets at a significant gain can move overseas and in many cases sell up free of any UK taxes. Provided overseas taxes are also avoided this can lead to a CGT free disposal. As many of you will know, to avoid UK CGT you will need to be non resident for 5 tax years. This stops someone leaving the UK, and selling up free of CGT when the gain has arose over the previous period of UK residence. The Revenue view here is that as the gain has arisen during the period of UK residence they want their share of the CGT. However there are circumstances when you can still sell up free of CGT and not be required to remain overseas for five years.
