Moving abroad to avoid inheritance tax
As well as avoiding income tax and capital gains tax by moving offshore avoiding inheritance tax is often a key concern.
In order to avoid inheritance tax you would need to ensure:
- Firstly that you lost your UK domicile
- Secondly that you either held your assets overseas or had UK assets that were covered by the nil rate band.
Unlike income tax and Capital gains tax, inheritance tax depends on your domicile status, and not your residence status. In order to lose your domicile status and avoid Inheritance tax you would need to make a permanent break from the UK and fix your sole or chief home overseas.
As it's often looked at retrospectively (ie after your death) the Revenue will look at the whole of your life and your lifestyle to try and ascertain exactly what your intentions were. If you therefore moved back to the UK for medical treatment etc later on in life this could make a claim to non UK domicile status difficult to accept.
It is though perfectly possible to avoid inheritance tax by moving offshore.
