Disclosing capital gains on UK investments when overseas

Anyone who ceases to be UK resident and non UK ordinarily resident will be exempt from UK capital gains tax. The anti avoidance requirements provide that you need to remain overseas for a period of at least five complete tax years to avoid a CGT charge in the tax year of your return. There are certain limited exceptions, however this represents the general rule. In terms of disclosure, if you're non resident and have moved overseas you will be under no obligation to disclose the gain on your tax return for the year of disposal. If you remain overseas and meet the five year rule any capital gain arising will therefore never be disclosed on a UK tax return. If you return to the UK before the five years is up you would then be charged to CGT in the tax year of return and you would need to enter any capital gain arising onto the tax return for the tax year of your return.
